What changed in 2025 — and why the window is everything

For years, a timely-filed renewal in eligible categories automatically extended an expiring EAD — most recently by up to 540 days — so a slow USCIS didn't cost people their jobs. That protection is gone for new filings: under a DHS interim final rule, renewals filed on or after October 30, 2025 no longer receive an automatic extension. The narrow exceptions are extensions provided directly by statute or by Federal Register notice for certain TPS-related documentation (TPS-related extensions were separately capped at one year, or the duration of TPS if shorter, for applications pending or filed on or after July 22, 2025).

At the same time, a December 2025 policy update set the maximum validity of new and renewed EADs at 18 months for the highest-volume categories — asylum-based, adjustment-based, withholding, and others that previously received longer cards. Renewals now come around faster, and nothing bridges a gap.

The arithmetic that remains in your control: USCIS accepts renewal filings up to 180 days before the card expires, and recommends filing at least 90 days out. With no automatic extension behind you, the 180-day mark is not an optimization — it is the protection.

What a gap actually means

If the new card has not arrived by the day the old one expires, most people must stop working — and an employer running I-9 reverification has no discretion about it. The cost of filing at day 180 instead of day 60 is zero; the cost of the reverse can be a paycheck.

Questions people actually ask

Do I still get the 540-day automatic extension?

Only if your renewal was filed before October 30, 2025 and qualified under the old rule (or if a statute or a TPS Federal Register notice specifically extends your documentation). Renewals filed on or after that date do not receive an automatic extension.

How early can I file my EAD renewal?

USCIS accepts Form I-765 renewals up to 180 days before your current card expires, and recommends filing no later than 90 days out. This calculator marks both dates from the expiration you enter.

How long will my new card be valid?

Since the December 2025 policy update, new and renewed EADs in the major categories (including asylum-pending, asylum granted, refugee, withholding, and adjustment-pending) are issued for a maximum of 18 months. Some categories differ — DACA remains 2 years, and a few categories run longer.

What happens if my EAD expires while my renewal is pending?

For renewals filed on or after October 30, 2025, employment authorization generally lapses with the card — there is no automatic bridge. That is precisely why the filing window at the top of this page exists.
